Terms of Service

1. Acceptance of Terms

By creating an account or using the Tuna mobile application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.


2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.

By using the Service, you represent and warrant that you meet these eligibility requirements.


3. Account Registration

3.1 Account Creation

To use the Service, you must create an account using a valid email address or through a supported third-party authentication provider (Google Sign-In, Sign in with Apple). You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 One Account Per Person

Each individual may maintain only one account. Shared or duplicate accounts may be terminated.


4. Description of Service

Tuna is a meal planning, pantry tracking, and nutrition logging application. The Service includes:

  • Pantry management — tracking food inventory, quantities, and expiration dates
  • Meal planning and logging — planning meals, logging food consumption, and tracking nutrition
  • Recipe management — creating, importing, and organizing recipes
  • Grocery list creation — building shopping lists from recipes and pantry needs
  • Barcode scanning — identifying packaged food products via barcode
  • Receipt scanning — extracting purchase data from grocery receipts using optical character recognition (OCR)
  • AI-powered features — nutrition estimation from photos and descriptions, recipe parsing from URLs and text, nutrition label interpretation
  • Spending analytics — tracking grocery spending and cost-per-meal data
  • Household sharing — sharing pantry, recipes, and meal plans with household members
  • Dashboard and insights — visualizing nutrition, spending, and eating patterns over time

5. Subscription and Billing

5.1 Free Tier

The Service offers a free tier with limited access to certain features. Free-tier users receive a limited lifetime number of uses for AI-powered features (such as recipe import, meal estimation, and receipt scanning). These limits do not reset monthly. Specific usage limits are displayed within the App and may change at our discretion.

5.2 Big Tuna Subscription

A subscription ("Big Tuna") provides unlimited access to all features. Subscription plans and pricing are as follows:

  • Monthly: $5.99 per month
  • Annual: $59.99 per year

Prices are in US dollars and are subject to change. We will notify existing subscribers before any price increase takes effect for their next billing cycle.

5.3 Payment Processing

All payments are processed by Stripe, Inc., our third-party payment processor. By subscribing, you also agree to Stripe's terms of service. We do not store credit card numbers or payment method details on our servers.

5.4 Billing Cycle and Renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless canceled before the renewal date. You will be charged at the then-current rate at each renewal.

5.5 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal, accessible from within the App. Upon cancellation:

  • Your subscription remains active through the end of the current billing period
  • You will not be charged for subsequent billing periods
  • After the billing period ends, your account reverts to the free tier
  • Your data is retained and accessible; only Big Tuna feature access is limited

5.6 Refunds

Monthly subscriptions. Because the free tier provides unlimited access to core features and limited access to Big Tuna features — allowing you to evaluate the Service before subscribing — monthly subscription payments are generally non-refundable. If you are unsatisfied, you may cancel at any time and your subscription will remain active through the end of the current billing period.

Annual subscriptions. If you purchased an annual subscription and are unsatisfied with the Service, you may request a full refund within 14 days of your initial purchase, provided you have not exceeded 20 uses of AI-powered Big Tuna features (recipe import, receipt scanning, meal estimation, or nutrition label scanning) during that period. After 14 days, or after exceeding 20 Big Tuna feature uses, annual subscriptions are non-refundable but may be canceled to prevent renewal.

Billing errors. If you were charged in error (duplicate charge, charge after cancellation, or unauthorized charge), contact us and we will issue a full refund promptly.

How to request a refund. Email hello@tuna-app.com with your account email address and a brief description of the issue. We aim to process refund requests within 5 business days.

Discretionary refunds. We may, at our sole discretion, issue full or partial refunds outside of the above policy in cases where we determine it is warranted.

5.7 Household Benefits

Big Tuna subscribers may invite members to their household. Invited household members receive Big Tuna-level access as part of the subscriber's plan. If the subscriber cancels, all household members revert to the free tier.


6. User Content

6.1 Your Content

You retain ownership of all content you create, upload, or submit through the Service, including recipes, photos, food descriptions, and other materials ("User Content").

6.2 License Grant

By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and process your User Content solely for the purpose of providing, maintaining, and improving the Service. This license continues for as long as your User Content is stored on the Service, and terminates when you delete your content or your account.

6.3 Content Standards

You agree not to submit User Content that:

  • Infringes on any third party's intellectual property rights
  • Contains false or misleading information presented as factual
  • Is unlawful, harmful, threatening, abusive, or otherwise objectionable
  • Contains malicious code or is designed to disrupt the Service

6.4 Personal Foods and Admin Review

When you create custom food items that do not match existing entries in our food database, these may be reviewed by our team for potential inclusion in the shared food taxonomy. If included, your custom item may be merged, modified, or made available to other users in a generalized form. Your personal data is never shared; only the food name and nutritional information may be incorporated.

6.5 Recipe Import

The recipe import feature extracts and reformats recipe information from URLs you provide. You are responsible for ensuring you have the right to use any recipe content you import. We do not claim ownership of imported recipe content and store it only within your account (and household, if applicable).


7. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent rate limits, access restrictions, or security measures
  • Use automated scripts, bots, or scraping tools to access the Service
  • Resell, redistribute, or commercially exploit the Service without authorization
  • Impersonate another person or misrepresent your affiliation with any entity
  • Use the Service to collect personal information about other users without their consent
  • Share your account credentials with others (use Household invitations instead)

8. AI-Powered Features and Disclaimers

8.1 Nature of AI Estimates

The Service uses artificial intelligence and machine learning to provide certain features, including but not limited to:

  • Estimating nutritional content of meals from photos and text descriptions
  • Parsing recipes from URLs and text input
  • Interpreting nutrition labels from photos
  • Classifying items on scanned grocery receipts

These AI-powered features generate estimates, not verified measurements. Nutritional estimates include a confidence score (displayed in the App) indicating the estimated reliability of the result.

8.2 Accuracy Disclaimer

AI-generated nutritional estimates may be inaccurate. Actual nutritional content can vary based on preparation method, portion size, specific ingredients, and other factors. You should not rely solely on AI-generated estimates for dietary decisions, particularly if you have food allergies, medical dietary restrictions, or specific health conditions.

8.3 Not Medical or Nutritional Advice

THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL, NUTRITIONAL, OR DIETARY ADVICE. The information provided through the Service, including nutritional data, calorie counts, macro and micronutrient breakdowns, and any health-related insights, is for informational and tracking purposes only.

You should consult a qualified healthcare professional, registered dietitian, or nutritionist before making significant changes to your diet, especially if you have or suspect you have a medical condition, food allergy, eating disorder, or other health concern.

8.4 Nutrition Database

Nutritional data in the Service comes from multiple sources, including the USDA FoodData Central database, OpenFoodFacts, product labels, and AI estimates. While we strive for accuracy, we do not guarantee the completeness or correctness of any nutritional information.


9. Third-Party Services

The Service integrates with or relies on the following third-party services:

  • Supabase — database hosting, user authentication, and file storage
  • Stripe — payment processing and subscription management
  • OpenFoodFacts — food product identification via barcode lookup
  • Google Sign-In / Sign in with Apple — optional authentication providers
  • PostHog — product analytics (see Privacy Policy)
  • Firebase Crashlytics — error and crash reporting (see Privacy Policy)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.


10. Intellectual Property

10.1 Our Property

The Service, including its design, code, features, user interface, and documentation, is owned by Tuna and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding.

10.2 Feedback

If you provide suggestions, ideas, or feedback about the Service, we may use them without restriction or obligation to you.


11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.


12. Account Termination

12.1 By You

You may delete your account at any time through the App. Account deletion permanently removes your profile, meal logs, pantry items, recipes, and all associated data. If you own a household, deleting your account also deletes the household and all shared data within it. This action cannot be undone.

If you have an active subscription, you should cancel it before deleting your account to avoid being charged after deletion.

12.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we reasonably believe continued access poses a risk to the Service or other users. We will make reasonable efforts to notify you before or at the time of termination, except where prohibited by law or where immediate action is necessary.


13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, error-free, or secure
  • Nutritional data, cost calculations, or other information will be accurate or complete
  • AI-generated estimates will be reliable or suitable for any particular purpose
  • The Service will meet your specific requirements or expectations

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUNA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Health consequences resulting from reliance on nutritional information provided by the Service
  • Financial losses resulting from reliance on cost or spending data provided by the Service
  • Damages arising from unauthorized access to your account

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).


15. Indemnification

You agree to indemnify, defend, and hold harmless Tuna and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

16. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction.


17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of laws principles.


18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.


19. Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Tuna regarding your use of the Service.
